A 2019 systematic review published in the Systematic Review of Malpractice Litigation in the Diagnosis and Treatment of Acute Stroke identified 246 U.S. medical-malpractice cases related to acute ischemic stroke and 26 related to intracranial hemorrhage, totaling 272 stroke-related cases.
Among these cases, 71 involved an alleged failure to administer tPA, which is a thrombolytic or a clot-busting drug, and 7 alleged a failure to timely treat with thrombectomy.
Thrombectomy is the use of a mechanical device or retrieval device to treat a large vessel occlusion. Thrombectomies are usually managed by neurointervential radiologists, in a neuro interventional radiology department.
The outcomes of these stroke-malpractice cases were as follows: approximately 56% ended with no payout, 27% settled out of court, and 17% resulted in a plaintiff verdict.
